California law governing medical marijuana is covered in: California Health and Safety Code, Section 11362.7 - 11362.83. A patient in possession of a valid identification card cannot be arrested for possession of marijuana under this law (typically up to a certain amount - 8 ounces.) However, the possession of a fake identification card, or a card obtained through fraudulent means, is a criminal offense in itself.
