Search and Seizure in Orange County, California
Search and seizure is an issue which many Orange County drug crime cases have in common. When law enforcement does not execute a legal search warrant or otherwise violates a person's rights in regards to a search of their property or person, this may be grounds for the suppression of key evidence - resulting in an acquittal or dropped charges.
As an Orange County drug crimes attorney, I understand how to recognize an illegal search and seizure and prove this in court to secure an acquittal, or prove this before a case goes to trial in order to secure dropped charges for my client.

My name is Barney B. Gibbs, and I have over 25 years of experience as an Orange County defense lawyer. I am familiar with search and seizure issues as they relate to drug crime cases, including such cases as drug possession, drug cultivation, drug manufacturing, drug distribution and drug trafficking.
Search and Seizure & Fourth Amendment Rights
The Fourth Amendment to the U.S. Constitution outlines protection for citizens against "unreasonable" search and seizures of property conducted by law enforcement. If certain evidence was found by the Court to be acquired by an unreasonable search and seizure, anything acquired in that search cannot be used as direct evidence against the defendant. This is also referred to as the "exclusionary rule" and can be viewed as a means of deterring law enforcement from conducting illegal search and seizures.
As a defense attorney, I truly believe that Fourth Amendment rights are important and deserve to be upheld. In many drug crime cases, everything may come down to whether a search and seizure was reasonable or unreasonable. As an attorney, I understand what is needed to help prove an unreasonable search in order for the Court to rule in my client's favor. This one action, successfully carried out, can result in an entirely different outcome for my client's drug crime case.
