Under the Influence Lawyer in Orange County
Being under the influence of a controlled substance (excluding medical marijuana) is illegal in California. As an Orange County drug crimes defense lawyer, the burden is on my shoulders to help my clients avoid a conviction in these cases, as well as imprisonment. As a lawyer, I will need to prove that my client was legally prescribed or given the drugs or that he/she was actually not under the influence of any controlled substances.
Barney B. Gibbs: Orange County Defense Attorney
My name is Barney B. Gibbs, and I have over 25 years of experience as an Orange County criminal attorney. I have personally handled over two thousand cases and have been able to secure a dismissal of charges in over one thousand cases. I have also taken over one hundred cases through to a jury trial. In taking on a new case involving drug use, I take the time to get to know my client and understand exactly what he/she has gone through in every aspect of any investigation, arrest and charges. My purpose is to obtain as much information as possible - any of which may be essential in building an effective defense strategy.
As a defense lawyer, I always go the extra mile for my clients. I am not afraid of spending my time and effort in going through a case and charges with a fine-toothed comb. I conduct an independent investigation in order to uncover important evidence or witness testimony which may overturn a case in my client's favor. I do whatever I can, as an attorney, to help my client receive the best possible outcome for his/her case.
I handle drug use cases and charges throughout Orange County, including Tustin, Irvine, Anaheim, Costa Mesa, Westminster, Santa Ana and Fullerton.
Orange County Under the Influence Law
Under California Health and Safety Code, Section 11550, an individual who is found to be illegally under the influence of a controlled substance may face at least 90 days in jail. The maximum sentence is 1 year in county jail. Enhanced penalties may be assessed, if the individual has prior convictions for drug crimes on his/her record, and if any weapons charges or other, drug-related offenses have occurred.
A licensed drug rehabilitation program may be able to be sought in lieu of jail time, in some cases. As a lawyer, I play a major role in securing alternative sentencing for my clients in drug use cases.
